MLS® VOW Terms of Use

By registering for and using this Virtual Office Website (the “MLS® VOW”), you (the “Registrant”) expressly acknowledge and agree, in favour of the MLS® VOW Participant, the corresponding brokerage, and the Board (Chilliwack and District Real Estate Board, Fraser Valley Real Estate Board, and Greater Vancouver REALTORS®), as follows:

  1. You have received, read, and understood the form published by the British Columbia Real Estate Association entitled “Privacy Notice and Consent.” (view the Privacy Notice and Consent)
  2. You acknowledge that you are entering into a lawful REALTOR®/consumer or REALTOR®/client relationship with the Member.
  3. All data obtained from the MLS® VOW is intended for, and may only be used for, your personal, non-commercial use.
  4. You have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the MLS® VOW.
  5. You will not yourself, and will not permit or assist others to, directly or indirectly:
    1. copy, redistribute, or retransmit any of the MLS® VOW Data or information provided;
    2. display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any of the MLS® VOW Data to another person;
    3. engage in Scraping (including “screen scraping” and “database scraping”), “data mining,” or any other activity intended to collect, store, re-organize, summarize, or manipulate any MLS® VOW Data or any related data.
  6. You acknowledge the Board’s ownership of, and the validity of the Board’s proprietary rights and copyright in, the MLS® VOW Data and listing information.
  7. You expressly authorize the Board, or its duly authorized representatives, to access the MLS® VOW and your information provided to the MLS® VOW Participant, for the purposes of verifying compliance with and pursuing enforcement of these Terms of Use and all applicable rules, regulations, bylaws, policies, and laws.

No Financial Obligation or Agency Relationship

These Terms of Use do not impose any financial obligation on you, and do not create an agency agreement with you. Any financial obligation or agency agreement will be set out separately, will be prominently labelled, and will not be accepted solely by mouse click. You will receive a subsequent confirmation of the terms of any such financial obligation or agency agreement, and it will not become effective until you acknowledge acceptance of those terms by mouse click. Prior to entering into any agency agreement with you, the MLS® VOW Participant will ask whether you are a party to any other agency agreements.

Access and Passwords

Your user name and password are unique to you. Your password and access to MLS® VOW Data will expire on a date not later than 30 days after being issued, and passwords are not automatically renewed. Upon expiration, you must provide a new password to regain access, and access will not be restored until the MLS® VOW Participant has sent a confirmation e-mail and you have acknowledged receipt by mouse-clicking the acknowledgement displayed in that e-mail.

Privacy Policy

This MLS® VOW collects and uses your personal information as described below. By registering, you consent to these practices.

The personal information you provide during registration (including your name and e-mail address, and any other information you supply) is collected and used to establish and maintain your access to the MLS® VOW, to communicate with you about your account, and to administer and enforce these Terms of Use.

You consent to the collection, use, and disclosure of your personal information for the purposes described above. You acknowledge and consent that your personal information may be shared with the Board for auditing and/or legal purposes.

Your information is retained in accordance with the MLS® VOW Participant’s record-keeping obligations and applicable law. For full details on how the British Columbia Real Estate Association handles your information, please review the Privacy Notice and Consent.
